1. MEMBERSHIP & ELIGIBILITY
The Luxxista Rewards Program (the "Program") is a free rewards program offered by Artisanal Expressions, Inc. (hereinafter "Caffe Luxxe") to its customers located throughout the United States Membership in the Program ("Membership") is limited to individuals only and is limited to one account per individual. You must be:
A legal resident of the United States to be eligible for Membership and at least 18 years old.
The Luxxista Rewards Program (the "Program") is a free rewards program offered by Artisanal Expressions, Inc. (hereinafter "Caffe Luxxe") to its customers located throughout the United States Membership in the Program ("Membership") is limited to individuals only and is limited to one account per individual. You must be:

Caffe Luxxe reserves the right to change or modify any of the terms and conditions contained in the Luxxista Rewards Program Terms & Conditions, and Policies from time to time at any time, without notice, and in its sole discretion. If Caffe Luxxe decides to change these Luxxista Rewards Program Terms & Conditions, Caffe Luxxe will post a new version on its website(s) and on the mobile app (Apple/Android) and update the date set forth above. ANY CHANGES OR MODIFICATIONS TO THESE LUXXISTA REWARDS TERMS & CONDITIONS, AND POLICIES WILL BE EFFECTIVE UPON POSTING OF THE REVISIONS. THE UPDATED LUXXISTA REWARDS PROGRAMS TERMS & CONDITIONS WILL REPLACE THE PRIOR VERSION AND ARE APPLICABLE TO ANY FUTURE DISPUTES BETWEEN THE PARTIES, REGARDLESS OF WHEN THE DISPUTED INTERACTIONS AROSE.
2. LUXXISTA REWARDS PROGRAM GENERALLY
The Luxxista Rewards Program is a tiered rewards and benefits program offered by Caffe Luxxe for customers to earn reward points on purchases that may be redeemed on future purchases along with other Program benefits. There are five (5) tiers of membership in the Program: Grey, Silver, Gold, Platinum, and Legend. Achieving Silver, Gold or Platinum status requires a minimum spend per year, as explained below. Luxxista Legend is the top tier of the Program with enhanced benefits and bonuses that are achievable only by a paid annual membership subscription.
Benefits (as defined below) may vary by tier and some tiers may have more Benefits than others. The type, timing and availability of any Benefits including but not limited to special offers, one-of-a-kind experiences, exclusive events and advance access to products will be determined by Caffe Luxxe in its sole discretion.
Caffe Luxxe may, in its sole discretion, alter, limit, or modify the tier rules, regulations, benefits, eligibility for membership, or any other feature of a particular tier or may terminate a particular tier at any time in its sole discretion, without prior notice except as expressly set out in these Terms or required by applicable law.

3. SIGNING UP FOR LUXXISTA REWARDS
The Program rewards and benefits offered in the Grey, Silver, Gold and/or Platinum tiers can be signed up for through either the mobile app (Apple/Android) or directly through the Caffe Luxxe website, www.caffeluxxe.com. If signing up for the Program through the website, you must complete enrollment through the Program website app interface. Signing up for only a caffeluxxe.com account is not sufficient, and enrollment will not be considered active otherwise. Signing up for the Program requires your name, phone number, email, and date of birth. The phone number will be verified with 2-factor authentication.
The Luxxista Legend tier of the Program is only currently available through the mobile app. The annual membership fee will be charged at that time and renews automatically on an annual basis unless canceled.

4. MEMBERSHIP TIERS
Standard Program Tiers
There are four (4) tiers in the standard Luxxista Rewards Program: Grey, Silver, Gold, and Platinum. Tier points are earned from qualifying purchases in-caffe or online and determine your tier status. Grey is the initial tier for new members and does not have any minimum spend per year. Achieving Silver, Gold, or Platinum tier Program status requires a minimum spend per year, as explained below. All Program tiers are subject to point expiration (both rewards points and tier points) if minimum purchase frequency is not met, as explained below.
All standard Program tiers enjoy the following benefits:
- Spend your points towards certain purchases in-caffe and online
- Access to exclusive offers and surprise bonus point moments
- Happy Birthday drink (after $25 spend for Grey tier)
Grey Tier
All Luxxista Rewards Program members are automatically in the Grey tier upon enrollment. Members will remain at the Grey Tier indefinitely unless the minimum annual spend/tier points required to achieve Silver, Gold, or Platinum tier status is achieved or Legend membership is purchased. Earned reward points and tier points expire and are forfeited if no purchase is completed within a consecutive six (6) month period.
Grey Tier enjoys the following benefits:
- Earn 0.1 points per $1*
- Redeem 1 point = $1
* Rounded down to the whole dollar (e.g., spend $1.30 = earn 0.1 points, spend $2.90 = Earn 0.2 points, spend $5.00 = earn 0.5 points)
Silver, Gold & Platinum Tiers
Silver, Gold, or Platinum Program tier status is achieved on those registered Luxxista Rewards Program members who spend a minimum on certain in-caffe and online purchases during an annual period, as explained in the Tier Upgrade Cycle below.
Higher Program tiers enjoy the following benefits with a minimum annual spend*:
Silver
- Achieve $1,000 minimum annual spend within a 365 day calendar year (from you enrollment date)
- +25% points per $1 spent (over Grey)
- Example: Spend $1.00 = Earn 0.1 points; Spend $5.00 = Earn 0.6 points
- Free welcome to the club drink
Gold
- Achieve $3,000 minimum annual spend within a 365 day calendar year (from your enrollment date)
- +50% points per $1 spent (over Grey)
- Example: Spend $1.00 = Earn 0.1 points; Spend $5.00 = Earn 0.7 points
- Free welcome to the club drink + croissant
Platinum
- Achieve $6,000 minimum annual spend within a 365 day calendar year (from your enrollment date)
- +100% points per $1 spent (over Grey)
- Example: Spend $1.00 = Earn 0.2 points, Spend $5.00 = Earn 1 point
- Free welcome to the club 2 drinks + 2 croissants. Bring a friend to celebrate!

Luxxista Legend Program Tier
Luxxista Legend is an annually paid subscription Program tier membership that offers all the benefits of the standard tiers with additional exclusive benefits. The Program membership will automatically renew on an annual basis unless cancelled before renewal. Members will retain access to their benefits until the date the subscription ends. Once the subscription has ended, members will be returned to the corresponding standard tier with that tier’s benefits.

5. TIER STATUS & UPGRADE CYCLE
For the four (4) tiers in the standard Luxxista Rewards Program, all points expire after six (6) consecutive months with no purchases made during that time period, and Program tier status will be reset to Grey. To maintain Program tier status, you must make minimum annual spend for Membership Tier.
If you don't achieve the minimum annual spend within a 365 day calendar year (from your enrollment date) , your Program tier status will be automatically moved back down to the corresponding Program tier status. You can find out the date your Program tier will expire in your account (based on the date of your last Caffe Luxxe purchase) by locating your Transactions in the mobile app (Apple/Android), please click on My Account and Transactions.
Luxxsita Legend members’ points will not expire so long as Luxxista Legend membership is active. If the Luxxista Legend Membership ends (canceled or expired), the member will revert back into the corresponding Membership Tier based on minimum annual spend Membership Tier eligibility.
6. EARNING POINTS
Earn Program reward points per $1 spent* at the time of qualifying purchase in-caffe or online. Higher Program tier statuses receive a higher point earning bonus. Certain products and charges are excluded from earning Program reward points including gift cards, wallet top-up purchases, and shipping charges. Program points earned reflect the item price after any other applied discounts or promotions. For the occasional bonus point promotion and types of promotions, various additional terms and conditions may apply. See specific promotion for specific details and terms. To earn Program points, you must follow the procedures described below for in-caffe and online purchases.
*Physical gift card purchases and wallet top up purchases do not qualify for Program points – Program points are earned when those gift card / top up credits are spent. Shipping charges are excluded from earning Program points.
In-Caffe
To earn Program points for in-caffe purchases, the member must use the Luxxista Rewards mobile app (Apple/Android) and scan their member code prior to purchase with cash, credit/debit card, or mobile wallet. Program members are responsible for scanning their member code for each Caffe Luxxe purchase. Physical gift card purchases and wallet top up purchases do not qualify for points.
Caffeluxxe.com Purchases
To earn Program points for CaffeLuxxe.com orders, you must sign up for and be signed into a Luxxista Rewards Program account and also have an active and valid CaffeLuxxe.com account. A Luxxista Rewards Program account may be signed up for through the Luxxista Rewards button on the CaffeLuxxe.com website or through the mobile app (Apple/Android). THE LUXXISTA REWARDS PROGRAM ACCOUNT AND CAFFELUXXE.COM ACCOUNTS ARE SEPARATE ACCOUNTS AND BOTH ARE REQUIRED TO EARN POINTS.
Prior to checkout, you must log into both the Luxxista Rewards Program (by clicking the “Luxxista Rewards” button on the CaffeLuxxe.com website) and be signed into your CaffeLuxxe.com account at https://www.caffeluxxe.com/account/login/.
To earn Luxxista Membership Tier points on subscriptions , the email address and phone number on your CaffeLuxxe.com account must match the email address and phone number on your Luxxista Rewards Program account. NOTE: Gift card purchases and shipping charges do not qualify for earning points.
7. REDEEMING PROGRAM REWARD POINTS
Program reward points have no cash value and can only be redeemed towards your purchase in store or online except with certain exclusions as described herein.
In-Caffe
To use Program rewards points for in-caffe purchases, the member must use the Luxxista Rewards Program mobile app (Apple/Android) and scan or enter their membership code at time of purchase. If the existing balance of reward points are insufficient to cover the entire purchase, the remaining balance of the purchase due must be paid with an alternate payment method (e.g., cash, credit/debit card, or mobile wallet). The member may choose how many points to apply towards a purchase.
Online
To redeem points online, you must be logged into both your caffeluxxe.com account and your Luxxista Rewards account through website app (yellow button, “Luxxisa Rewards”. For detailed instructions on using the Luxxista Rewards website app, please view the instructions Luxxista Rewards Website Instructions. Redeemed Points will be applied at checkout, and cannot be combined with any other discount or promotional offer.
Program rewards points cannot be used to pay any shipping charges and subscriptions, whether new or recurring (although you can earn points for your subscription purchases). Any incurred shipping charges and remaining order balances must be paid with an alternate form of payment (e.g., credit card, or mobile wallet).
The free shipping offer threshold is based on the order total minus discounts (including applied rewards points) and any applicable taxes.
8. BENEFITS EXPIRATION
To qualify and maintain any benefits, you must be an active member with at least one (1) purchase within a 6-month period. If no purchase is made for six (6) consecutive months, all benefits are forfeited, and your tier status resets to the base Grey tier. Legend benefits end when the membership expires and is no longer active. If the membership is cancelled prior to renewal date, benefits will remain active until the date of non-renewal. The date of non-renewal is considered the end of the active membership and member will reset to the corresponding standard membership per the tier rules.
For all memberships including Legend, awarded benefits and other promotions such as, but not limited to, “FREE Birthday Drink” have time limits and will expire if not claimed. See awarded benefits and promotions for specific terms and conditions.
9. POINTS EXPIRATION
Program reward and tier points expire after six (6) consecutive months with no purchase in-caffe or online registered to your account. Legend points don’t expire while membership is active.
10. MEMBERSHIP CANCELLATION, ORDER CANCELLATION & RETURNS
Members in standard Program tiers Grey, Silver, Gold, and Platinum may request for their membership to be to canceled at any time. Luxxista Legend membership may be canceled within 3 days from the Start Date, and receive a refund as long as no benefits have been used. If benefits have been used, the membership is not eligible for cancellation refund.
For any purchases with earned points and returned in-caffe, the earned points will be deducted from the member’s Luxxista Rewards Program account. For any online orders purchased with earned points, and subsequently cancelled, the earned points will be deducted from the member’s Luxxista Rewards Program account.
If a purchase is made using points, and returned in-caffe or online, the redeemed points will be returned to the member’s account.
11. AGREEING TO CAFFE LUXXE’S PRIVACY POLICY & EMAIL
Caffe Luxxe values your privacy. BY SUBMITTING AN APPLICATION FOR MEMBERSHIP IN THE LUXXISTA REWARDS PROGRAM, YOU AGREE TO BE BOUND BY CAFFE LUXXE'S APPLICABLE PRIVACY POLICY AND OUR WEBSITE TERMS OF SERVICE. As is explained in our privacy policies, we use, and retain the information we collect to, among other things, detect security incidents, and protect against malicious, deceptive, fraudulent, or illegal activity, including attempts to manipulate accumulated Luxxista Rewards and benefits or to violate these Terms.
12. COMMUNICATIONS WITH CAFFE LUXXE: HOW TO OPT OUT
By submitting an application for Membership in the Program, you agree to receive advertising, marketing materials and other communications from Caffe Luxxe. By signing up to join the Program, you will automatically be subscribed to receive Program emails.
If you do not wish to receive these communications, you can request that they be discontinued by clicking the “Unsubscribe link” in one of these communications, by emailing Customer Service at hello@caffeluxxe.com, or by calling Customer Service at (310) 394-2222.
13. CHANGES, TERMINATION AND/OR REMOVAL FROM PROGRAM, ACCOUNT CLOSURE
Program Changes: Caffe Luxxe may, in its sole discretion, alter, limit, or modify the Program rules, regulations, benefits, Rewards, eligibility for Membership, or any other feature of the Program (including assigning any of its obligations to customers under the Program at any time to another person or entity, without recourse) or may terminate the Program any time at its sole discretion, by posting any such changes on the Caffe Luxxe website. YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING SUCH CHANGES CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES.
Termination or Removal from Program: Caffe Luxxe reserves the right to exclude individuals from the Program, remove Luxxista Rewards Program Points from a member’s account and/or cancel orders that are not consistent with Caffe Luxxe policy in its sole but reasonable discretion. In particular, any abuse, manipulation or “gaming” of the Program or its rules (as determined by Caffe Luxxe) including multiple redemptions of Birthday Gifts by the same individual via different accounts, failure to follow any terms of the Program, including, but not limited to the eligibility requirements, Membership inactivity for more than six (6) consecutive months, reselling Program Rewards, any misrepresentation or any conduct detrimental to the interests of Caffe Luxxe not otherwise protected by law may subject members to Membership revocation or deduction of Program rewards or benefits obtained through these abusive or manipulative activities, cancellation of orders and will affect eligibility for further participation in the Program. Caffe Luxxe may use a third-party provider to monitor purchases and identify activities that violate the terms of the Program or Caffe Luxxe policy. Caffe Luxxe uses this data to help it make decisions regarding participation in the Program, awarding of Program rewards and/or benefits and order fulfillment. Membership is non-transferable and Membership purchases must be made by the member. If your Membership is revoked or otherwise cancelled, any Program rewards and/or benefits in your account will automatically expire. Caffe Luxxe reserves the right to make changes to its website and these Terms at any time. It is your responsibility to check or review these Terms from time to time to keep informed of any changes. By joining the Program, you hereby agree to be bound by any such changed Terms.
Account Closure: If you choose to close your Program Membership, you can do so by contacting Caffe Luxxe Customer Service at or via self-closure. Luxxista Rewards Program accounts that are closed can be re-opened upon request by contacting Caffe Luxxe Customer Service. If you close your Luxxista Rewards Program account, you must agree to the following terms of closure:
1. You will no longer be able to log into your Program account.
2. You will forfeit all of your existing Luxxista Rewards Program rewards and/or benefits, tier status, and other Program tier benefits.
3. You will no longer accrue Program points on purchases.
4. You will be opted out of all Caffe Luxxe marketing, including emails, SMS, and push notifications.
Closing your Luxxista Rewards Program account will not affect open orders or returns.
14. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, CAFFE LUXXE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM, INCLUDING DAMAGES ARISING OUT OF CHANGES TO OR TERMINATION OF THE PROGRAM. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. TO THE EXTENT PERMITTED BY LAW, THE LIMITATIONS ON CAFFE LUXXE’S LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BY AGREEING TO THESE TERMS, YOU WILLINGLY AGREE THAT YOU HAVE RELINQUISHED YOUR RIGHT TO SEEK THESE DAMAGES FROM CAFFE LUXXE AND THAT THIS IS A REASONABLE ALLOCATION OF RISK.
15. COPYRIGHT
All Program design, text, graphics, logos, button icons, images, audio clips, the selection and arrangement thereof, and all proprietary software is Copyright (c) of Artisanal Expressions, Inc., ALL RIGHTS RESERVED. The compilation (meaning the collection, arrangement and assembly) of all Program content is the exclusive property of Caffe Luxxe and protected by U.S. and international copyright laws. All software used in connection with the Program is the property of Caffe Luxxe or its software suppliers and is protected by U.S. and international copyright laws. Unless otherwise indicated one part of the Program materials, permission is granted to electronically copy and to print in hard copy portions of the Program materials for the sole purpose of accessing the Program and the services provided therein for personal use. Any other use of Program materials - including reproduction, modification, distribution, republishing, transmission, displayer performance - without the prior written permission of Caffe Luxxe is strictly prohibited.
16. RESOLVING DISPUTES
If a dispute should arise between you and Caffe Luxxe, we want to provide you with a resolution that is efficient and cost effective. In our experience, almost all customer service disputes can be resolved to your satisfaction by our customer service team, reachable by emailing hello@caffeluxxe.com or by calling 310.394.222
If your dispute cannot be resolved using our customer service team, these Terms describe how we shall proceed with the resolution of the dispute.
TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AND CAFFE LUXXE AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE PROGRAM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.
17. LEGAL DISPUTES; CLASS ACTION WAIVER; JURY TRIAL WAIVER
IF YOU ARE A U.S. RESIDENT, YOU ALSO AGREE TO THE FOLLOWING PROVISIONS:
PLEASE READ THIS SECTION CAREFULLY - IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION AND TO HAVE A TRIAL IN FRONT OF A JURY.
NO CLASS ACTIONS: EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ITS RIGHT TO PARTICIPATE IN A CLASS OR COLLECTIVE ACTION AGAINST THE OTHER PARTY IN ANY DISPUTE OR PROCEEDING (WHETHER BASED ON CONTRACT, STATUTE, TORT, OR ANY OTHER THEORY). ALL CLAIMS MUST BE BROUGHT SOLELY IN A PARTY'S INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, REPRESENTATIVE ACTION OR PROCEEDING.
WAIVER OF JURY TRIAL: EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES, TO THE FULLEST EXTENT PERMITTED BY LAW, ANY AND ALL RIGHTS THEY MAY HAVE (INCLUDING BUT NOT LIMITED TO, THEIR CONSTITUTIONAL OR STATUTORY RIGHT TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JURY) TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING FOR ANY DISPUTES WHATSOEVER BETWEEN THE PARTIES, INCLUDING BUT NOT LIMITED TO, DISPUTES IN ANY WAY ARISING OUT OF OR RELATING TO THESE TERMS OR THE RELATIONSHIP OF THE PARTIES (WHETHER BASED ON CONTRACT, STATUTE, TORT, OR ANY OTHER THEORY).
18. CHOICE OF LAW/FORUM SELECTION
These Terms shall be governed by and construed in accordance with the laws of the State of California, excluding its conflict of law rules. If you are a U.S. resident you further expressly consent and agree to submit to the exclusive jurisdiction and venue of a court of competent jurisdiction located in Los Angeles County, California.
19. SEVERABILITY
The provisions of this Program are intended to be interpreted in a manner which makes them valid, legal, and enforceable. In the event any provision is found to be partially or wholly invalid, illegal or unenforceable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal, and enforceable. It is expressly understood and agreed between the parties that such modification or restriction may be accomplished unilaterally by Caffe Luxxe, or alternatively, by a court of law. If such provisions cannot under any circumstances be so modified or restricted, they shall be excised from the Program Terms without affecting the validity, legality or enforceability of any of the remaining provisions.
20. CALIFORNIA NOTICE OF FINANCIAL INCENTIVE
Under California law, loyalty programs may be considered a financial incentive. Because the Program involves the collection of personal information and offering of certain benefits, it might be interpreted as a “financial incentive” program under California law. Under California law, the value of your personal information to Caffe Luxxe is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Program, less the expense related to offering those products, services, and benefits to Program participants.
21. ADDITIONAL INFORMATION ON THE PROGRAM
